1. Acceptance of terms
By accessing or using MyDivePod, you agree to be bound by these Terms of Service. If you do not agree, please do not use our platform.
2. Platform role
MyDivePod is a marketplace that connects divers with liveaboard operators. We facilitate bookings but are not a party to the contract between you and the operator. Operator terms, cancellation policies, and trip conditions are set by each individual operator.
3. Bookings and payments
When you book a trip, you agree to pay the deposit to secure your spot and the balance per the operator's payment schedule. Deposits are non-refundable unless otherwise stated in the operator's cancellation policy. Payment processing is handled by Stripe.
4. Cancellations and refunds
Cancellation policies vary by operator and are displayed during checkout. MyDivePod's platform fee is non-refundable. In the event of an operator cancellation, we will work to facilitate a refund or rebooking.
5. Traveler responsibilities
You are responsible for ensuring all travelers hold valid passports, appropriate dive certifications, and any required travel insurance. Operators may refuse boarding if certifications or documentation are not in order. No refunds will be issued in such circumstances.
6. Loyalty program
The MyDivePod loyalty program allows you to earn and redeem points on bookings. Points have no cash value and are non-transferable. MyDivePod reserves the right to modify or terminate the loyalty program at any time with reasonable notice.
7. Reviews
Reviews submitted through MyDivePod must be truthful, based on genuine experience, and comply with our community guidelines. We reserve the right to remove reviews that violate these standards.
8. Limitation of liability
MyDivePod is not liable for any personal injury, property damage, or financial loss arising from your trip. Our liability is limited to the platform fees paid to MyDivePod in connection with the relevant booking.
9. Governing law
These terms are governed by the laws of Mexico. Any disputes shall be resolved through binding arbitration.
